Ohio’s New Attendance Law
Ohio’s Attendance Law Key Changes: The passage of Ohio's budget bill in 2025 has shifted Ohio's attendance law (formerly known as HB 410) from focusing almost solely on truancy to supporting students at risk of becoming chronically absent.
The new law requires
Early notification: notification at or before a student has 5% absence (approx. 45-50 hrs/7.5-8.5 days)
Proactive intervention for chronic absence risk
Tiered, root-cause focused interventions & support
Building Level Modifications
Discontinue:
Standalone attendance plans
Solely attendance-focused interventions
Punitive language in attendance supports
Prioritize Early Warning Dashboard:
Integrate root cause analysis into Tier 2 Teams (i.e. matriculation, MTSS/PBIS)
Refer to appropriate school and community support
Prioritize Empower Families:
Utilize Parent Portal for absence notifications and family empowerment
Prioritize RTI Module:
Utilize the Response to Intervention (RTI) Module to:
Document Tier 2 supports
Document Tier 3 lack of response to intervention prior to truancy filing
